Successful Cases

Fernando Fernandez vs. Inter-American Development Bank; IDBAT; Judgment No. 74 (2011).

Where:

Washington, D.C.

Attorney in Charge:

Samuel McTyre

The Fernandez case established for the IDB the principle of proportionality in sanctioning the misconduct of a staff member. Though the staff member was found to have engaged in misconduct under the Bank’s Code of Conduct, he did not engage in the level of misconduct that warranted his termination; thus, the complainant’s termination was annulled.

Alcyone Vasconcelos vs. UNESCO; ILOAT; Judgment No. 3942 (2018)

Where:

Geneva, Switzerland

Attorney in Charge:

Samuel McTyre

A UNESCO agency’s repeated refusal to reinstate the complainant constituted a continuous violation, by various devices, of the whistleblower protection to which she was entitled after filing a good-faith complaint against her supervisor for workplace harassment.

Juan Kassar vs. Secretary General of the OAS; OASAT; Judgment 154 (2008)

Where:

Washington, D.C.

Attorney in Charge:

Samuel McTyre

The Kassar case was a worker’s compensation matter focused on injured employees’ rights. It is often cited in other matters for establishing the right of access by a staff member to the considered and reasoned decisions made by an organization involving their status.

Yolanda Malovini vs. Inter-American Development Bank; IDBAT; Judgment No. 49; (2002)

Where:

Washington, D.C.

Attorney in Charge:

Samuel McTyre

This matter involved sexual harassment allegations against the Bank official in which the only witnesses were the accused and the accuser. Aside from standards of witness credibility, the case represents the first successful sexual harassment claim to come before the IDB AT.
